ASSISTED LIVING NURSES CHARGED WITH NEGLIGENT CARE OF RESIDENT

Seven former employees of a home for those with developmental and intellectual disabilities were recently charged by New Jersey prosecutors for failing to properly care for a resident with a broken finger. In April of 2012, the anonymous resident of Vineland Developmental Center in Cumberland County had fractured a finger. The now-indicted nurses had wrapped it in order to protect the broken finger, but done so too tightly, such that the hand developed gangrene over the next week. This resulted in the female resident’s hand being amputated just above the wrist the following month. The nurses now each face charges varying by individual, but including negligence; “serious mistake due to carelessness;” and “notoriously disgraceful conduct.” The State of New Jersey proposed closing the Vineland Developmental Center in 2011, but the large number of employees of the facility, as well as families of the residents, protested its closure, and it remained open.

Due to the limited abilities of impaired or elderly residents to understand what’s happening or speak out against it, neglect and abuse occurring in nursing homes and assisted living facilities can often occur unchecked. While you may trust the facility in which you’ve placed your loved one to ensure that he or she remains healthy and cared for, that trust can be abused in the form of failure to adequately treat injuries, failure to properly administer any necessary prescription drugs, or even failure to ensure that your loved one receives the social interaction and mental exercise needed to remain stimulated and happy.

If your loved one experiences injury or neglect while in a New Jersey nursing home or assisted living facility, seek out legal counsel that can help you protect your loved one’s rights to competent, attentive care.
