Driving Under the Influence of Drugs Morris County NJ Defense Attorneys

Parsippany NJ Drug DUI Penalties

In New Jersey, driving under the influence of drugs is prosecuted in much the same way as drunk driving.  DUI laws apply to anyone who operates a vehicle while under the influence of an “intoxicating liquor” or a “narcotic, hallucinogenic or habit-producing drug.”  The penalties for a DUI drug charge tend to be more severe than those associated with a DUI alcohol charge.  Additionally, drug related DUIs are treated the same as alcohol related DUIs. This means that you can face increased penalties for each Drug DUI violation you commit.  First time offenders face:

  • Jail sentence up to 30 days
  • Driver’s License Suspension of 7 months to 1 year
  • Motor Vehicle Commission (MVC) Surcharges up to $1,000 per year for 3 years
  • 12–48 hours at the Intoxicated Driver Resource Center (IDRC)

At the Law Offices of Smith & Doran, we understand the stakes involved and are ready to provide personal and effective legal representation.  We know how to fight for your future while at the same time always maintaining an open line of communication.  The lawyer you hire is the lawyer you get, every step of the way.  Contact us online or by phone at 973-261-6254 today to schedule your cost-free consultation.

Morristown NJ Defense Attorneys Challenge the State’s Evidence

Unlike alcohol, drugs are difficult to detect through a Breathalyzer® analysis. They may not be detected, or they may give a wildly inaccurate reading, especially if they were consumed with alcohol. A more accurate reading is likely with a blood test, but even that is not without its shortcomings. If the police conduct the blood test, they must follow a very specific procedure. Since they are generally not medical professionals, errors occur. They may also request a urine specimen, but you are not required to provide one.

The tests can detect prescription drugs as well as street drugs. Unfortunately, the fact that the drug was prescribed by your doctor does not get you off the hook, as most of these carry warnings not to operate vehicles or heavy equipment.

The prosecution also may relay on a drug recognition expert. A drug recognition expert (or drug recognition evaluator) is a law enforcement officer who has received specialized training to recognize the signs of drug impairment in drivers. In evaluating a suspect, the DRE may analyze physical, psychological and toxicology tests, as well as review statements and conduct interviews.
