A Laflin, Pennsylvania woman recently filed a wrongful death lawsuit against a New Jersey couple, alleging that they are responsible for the car crash that caused her husband’s death.

The crash occurred in July 2012 on the Pennsylvania Turnpike. According to the plaintiff, Evelyn Jones, she was traveling along the freeway through the city of Duryea when she crashed into a carthat had stopped in the center of the travel lane. Another car traveling in front of Jones swerved and narrowly missed the parked car, and although Jones reportedly tried to take evasive action, she was unable to avoid a collision.

Her 77-year-old husband, David, was riding as a passenger. He suffered catastrophic injuries and passed away after 10 days in critical condition.

In June 2014, Jones filed a wrongful death lawsuit against the stopped car’s driver, Samuel Desmine, and his wife, Grace. The lawsuit alleges the following:

• That because Desmine had dementia and suffered from a severe sugar imbalance, he should not have been permitted to operate a vehicle.
• According to the suit, Samuel Desmine’s condition caused him to stop his car illegally in the freeway’s travel lane, and he failed to give any warning or turn on his car’s flashers.
• The lawsuit states that the Desmines did not take proper precautions to protect other drivers on the road.

Of course, no type of settlement or monetary award can truly compensate for Mrs. Jones’ loss.
