ASSISTED LIVING NURSES CHARGED WITH NEGLIGENT CARE OF RESIDENT

Seven former employees of a home for those with developmental and intellectual disabilities were recently charged by New Jersey prosecutors for failing to properly care for a resident with a broken finger. In April of 2012, the anonymous resident of Vineland Developmental Center in Cumberland County had fractured a finger. The now-indicted nurses had wrapped it in order to protect the broken finger, but done so too tightly, such that the hand developed gangrene over the next week. This resulted in the female resident’s hand being amputated just above the wrist the following month. The nurses now each face charges varying by individual, but including negligence; “serious mistake due to carelessness;” and “notoriously disgraceful conduct.” The State of New Jersey proposed closing the Vineland Developmental Center in 2011, but the large number of employees of the facility, as well as families of the residents, protested its closure, and it remained open. 

PINK CONCERT NOT HARMFUL TO 11-YEAR-OLD, NEW JERSEY FAMILY PART JUDGE DETERMINES

In an ongoing custody dispute, an attempt to show that harm was caused by a mother bringing her 11-year-old daughter to a Pink concert, has failed. The father raised the issue in a hard-fought ongoing post-judgment custody dispute, for which both parties are self-represented, and which involves two children in addition to the 11-year-old daughter.

FAMILY OF TODDLER KILLED AT CHESTER FARM FILED NOTICE OF INTENT TO SUE TOWNS

The family of Ella Fuehring, a 2-year-old girl killed while attending Harvest Fest at Chester Township’s Alstede Farms, has recently filed notices of intent to sue multiple public agencies, including Chester Borough, Chester Township, the New Jersey Department of Agriculture, the County of Morris, and local police departments. Notices of intent to sue must be filed prior to filing a lawsuit against public agencies. The Fuehrings’ notice also lists Alstede Farms, a private entity, as a potential defendant, as well as the driver of the shuttle that struck Ella. 

STATE APPEALS COURT REVERSES LOWER COURT’S DECISION IN LEGAL MALPRACTICE SUIT

Earlier this month, a panel of New Jersey judges reversed a lower court’s decision, thereby reinstating a lawsuit against Superior Court Judge Mary F. Thurber for legal malpractice. The lawsuit alleges that the judge mishandled an estate dispute while working in private practice.
